Miami Mayor Tomás Regalado (R) became the latest Florida Republican to buck Gov. Rick Scott (R-FL) yesterday, attacking his error-riddled and likely illegal attempt to purge people his administration said were non-citizen voters from the voter rolls.

In an interview with NPR's Michel Martin, Regaldo dismissed Scott's notion that Florida is any kind of haven for wide-spread voter fraud:

REGALADO: I think that in Florida – and especially here in South Florida – we walk a very thin line in terms of communities. I mean, we are a real melting pot. And I think it's not fair just to use one brush and paint everybody, because the perception that we're getting throughout the country is that a bunch of Latino people just go out and vote right after getting off the plane or the raft when they come here. And that's not the case. Problem are, the laws. I mean, you can go and get your voter ID with your driver's license, and no questions asked. Well, the law has to be changed. But, you know, I doubt that we have a massive fraud going on here in Florida…

MARTIN: Have you expressed that to the governor, who shares your political party?

REGALADO: I have not spoken to the governor. And, you know, and I understand the governor is trying to cater to the conservatives, but that's not the way to do it. I mean, I don't see thousands of people not citizens voting here in South Florida. I mean, throughout the years, we have seen in the United States – remember Chicago many years ago – people that were dead voting and all that.But other than that, those are unique cases. I don't think that there is, like, this massive fraud. What we should do is encourage people to register and vote if you are citizens, because the problem is that all these controversies about voters and investigators and Justice Department and police after the voters is scaring people to vote. The people are going to say, well, it's too much trouble. So I might as well don't even bother to vote. And that's wrong because…

Parents and teachers, however, are fighting back with a sit-in today.

brutal: Chinese Government Forces Feng Jianmei to Have Seven-Month Abortion

"In China, Feng Jianmei says that she was forcibly injected with a chemical to induce an abortion, even though she was seven months pregnant. The abortion resulted in a stillborn child.

Pictures of the young woman and her dead baby, who was covered in blood have caused outrage and shock within the country and beyond its borders.

Because she already had a child, local birth-control authorities ordered her to pay a fine equal to about $5000.

However, Jianmei couldn't pay the fine because her mother-in-law needed the cash for a cancer treatment. 

So 20 members of the local family planning authority placed her under arrest and forcibly took her to a hospital where the abortion was performed against her will.

Chai Ling of the activist group 'All Girls Allowed' said this grisly incident proves how the country's 'One-Child Policy' continues today.

Li Yuongjou, deputy chief of the local  family planning department, denied there was any forced abortion: "A lot of us tried for days to educate her. She agreed to the (seven month) abortion herself.""

U.S. Men’s National Soccer Team Snubs American Troops #p2 #tcot

The U.S. Men's National Soccer Team (USMNT) wasn't exactly the country's sports darling heading into this week, and it most definitely didn't endear itself to anyone with this latest dumb move.

As team members stepped off their plane in Guatemala this past Monday, they were greeted by droves of soldiers who cheered them on as they walked towards the bus. Instead of stopping to chat with the troops and/or to thank them for their support, the players walked past them like they weren't even there.

Understandably, the folks who put their lives on the line so that USMNT players can continue to safely embarrass themselves at every international tournament weren't too happy with that reception.

The soldiers' friends and family took to Facebook to express their disgust -- writing messages like, "What a disgrace that a team that wears our American colors can't take 5 minutes to acknowledge the soldiers that fight for what those colors represent."

Grieving Father Struggles to Pay Dead Son’s Student Loans #p2 #tcot

A few months after he buried his son, Francisco Reynoso began getting
notices in the mail. Then the debt collectors came calling.
"They would say, 'We don't care what happened with your son, you have
to pay us,'" recalled Reynoso, a gardener from Palmdale, Calif.
Reynoso's son, Freddy, had been the pride of his family and the first to go to college. In 2005, after Freddy was
accepted to Boston's Berklee College of Music, his father co-signed on his hefty private student loans, making him
fully liable should Freddy be unwilling or unable to repay them. It was no small decision for a man who made just
over $21,000 in 2011, according to his tax returns.
"As a father, you'll do anything for your child," Reynoso, an American citizen originally from Mexico, said through a
translator.
Now, he's suffering a Kafkaesque ordeal in which he's hounded to repay loans that funded an education his son will
never get to use — loans that he has little hope of ever paying off. While Reynoso's wife, Sylvia, is studying to be a
beautician, his gardening is currently the sole source of income for the family, which includes his 18-year-old
daughter Evelyn.
And the loans are maddeningly opaque. Despite the help of a lawyer, Reynoso has not been able to determine
exactly how much he owes, or even what company holds his loans. Just as happened with home mortgages in the
boom years before the 2008 financial crash, his son's student loans have been sold and resold, and at least one was
likely bundled into a complex Wall Street security. But the trail of those transactions ends at a wall of corporate
silence from companies that include two household names: banking giant UBS and Xerox, which owns the loan
servicer handling the bulk of his loans. Left without answers is a bereaved father.
The risk of cosigning on Freddy's loans seemed to have been worth it when he graduated in May 2008 and began
looking for a job in the music industry. He was on the way back from a job interview on the evening of Sept. 4 when
he lost control of his car and it rolled over. Freddy's family learned of his death the next morning.

Public Understanding Of Climate Science Rebounds, 72% of Independents Say There Is ‘Solid Evidence’ Of Global Warming #p2 #tcot


Brookings has released a new survey that confirms other recent polls: Public understanding of climate science is rebounding, and the recent record-smashing extreme weather events are playing a key role.

As you can see, the biggest jump is from independents, demonstrating once again that global warming has become a major wedge issue. Many other recent polls have made that clear (see "Gallup poll: Public understanding of global warming gains" and "Independents, Other Republicans Split With Tea-Party Extremists on Global Warming"). Now if progressive politicians would only seize on this winning issue.

Perhaps even more remarkable than this rebound in understanding is the record rise in the public's confidence in their accurate understanding of climate science that the National Survey of American Public Opinion on Climate Change [NSAPOCC] found:

Just under two thirds of those who believe global warming is occurring stated that they were very confident of this position. This 63 percent confidence level is 14 percentage points higher than in the fall of 2011 and marks the highest level since the NSAPOCC began in 2008.

Why would confidence be growing, especially when the media and key opinion-makers have all but stoppedtalking about climate change?

Brookings had previously found that Americans' Understanding of Climate Change Is Increasing With More Extreme Weather, Warmer Temperatures. Certainly the American public is seeing for themselves the off-the-chart heat waves and other extreme weather that climate scientists have long said would become more common as we pour more heat-trapping greenhouse gases into the atmosphere (see NOAA Chief: U.S. Record of a Dozen Billion-Dollar Weather Disasters in One Year Is "a Harbinger of Things to Come"). That was especially true in March (see "March Came In Like A Lamb, Went Out Like A Globally Warmed Lion On Steroids Who Smashed 15,000 Heat Records").

The new survey added further evidence that "the growth in the percentage of Americans who see evidence of global warming appears to be related to individual perceptions of weather conditions and events.":

Disillusioned voters are checking out on Obama

Wake the F up, people. Do you really want Romney as President?! Obama won North Carolina by a sliver in 2008 (with a kick-@ss ground game and record turnout). And now Mittens for the first time holds a lead here.

"The presidential race in NC continues to be very close," Public Policy Polling Director Tom Jensen says. "This month we find Mitt Romney leading Obama 48-46. It's a small lead but it's still significant because it's the first we've found Romney leading Barrack Obama in our monthly polling since October.

Romney's gained seven points on Obama over the past two months alone. Jensen says Romney's small lead is probably heavily influenced by independent voters. "Romney's up to 20 percent of the democratic vote after being at 15 percent a few months ago," he says. "For a republican to win in North Carolina really requires winning over a lot of conservative democrats and that 20 percent of the democratic vote suggests Romney's doing a little bit better on that front."

Americans have such a short attention span; yeah, this President didn't give us all of the hopey-changey goodness he promised on the campaign trail, and I've been highly critical of his foot-dragging leadership on several fronts (yes, people, read my back catalog), but really — do people want Romney and his adviser Robert Bork packing the U.S. Supreme Court?

Considering the economic mess/slow recovery, the President has finally decided to cry uncle and declare the obvious — he needs more time, and the Romney alternative would be worse.

US Government Study: Humans are Security Threat to Oceans and our Planet #p2 #tcot

A new study published in Nature Climate Change, asserts that the warming of the world's oceans have everything to do with the effects of man. This scientific research has climate change alarmists excited over a new way to direct man-made climate change into the social meme.

According to the study, "We have identified a human-induced fingerprint in observed estimates of upper-ocean warming on multidecadal timescales."

Computer model data from research from Australia, Japan, India and the US proves that the temperature of the oceans and its variable fluctuations are not a natural occurrence. Causational information fabricated by suppositional computer models from the world's major oceans compared to climate alarmist's computer models shows that there is an excess of man-made influence.

The international team of researchers used for this study attributed only archrival computer models and assumed simulations and compared them to the supposed effects of fossil fuel emissions during the last century.

The report states that "When the global mean changes are included" the "anthropogenic fingerprint" is of 1% which is an insignificant level. Yet, this statistic is being blown out of proportion to create frenzy over the earth's victimization at the hands of humans.

Sheldon Adelson is giving $10 million to Mitt Romney super PAC #p2 #tcot

Casino mogul Sheldon Adelson, who helped prop up House speaker Newt Gingrich's primary campaign for months, is now using his millions to help former Massachusetts governor Mitt Romney.

According to two sources familiar with the donation, Adelson is giving $10 million to the pro-Romney super PAC Restore Our Future.

Romney is already catching up with President Obama in fundraising; this donation is yet another boost.


DOJ Reportedly Investigating Cable Companies For Squashing Online Competition #p2 #tcot


The Justice Department is reportedly engaged in an anti-trust investigation into many areas where the cable TV industry might be acting inappropriately to try and quell competition from online video. Many consumers want to pick and choose what they watch, using services like Hulu and Netflix, whereas cable companies would like them to continue to pay for bundles of TV channels, even some they might not watch.

According to sources cited by the Wall Street Journal, the Justice Department has already spoken to online video peddlers and has questioned Comcast, Time Warner Cable and other cable companies.

They're trying to figure out if cable providers have been setting data caps to limit the amount of data a subscriber can download each month in an attempt to keep consumers from viewing content that is outside of the cable companies' offerings.

Since many cable companies provide the high-speed Internet access needed for many consumers to stream video, some pay-TV companies are not too happy about their TV channels being bypassed for online video because of all the cash they've already invested in their current networks.

The TV industry has been tightly regulated for decades, and decisions that are made now could have a huge impact on how video services spread in the future. The probes are examining data caps that Comcast and AT&T use to deal with the uptick in video traffic on the Internet. Cable companies say those limits are necessary to keep the heaviest users from overwhelming the networks.

Harvard Grad Student: Racial Search Terms Correlate With Obama Opposition #p2 #tcot

"It's pathetic that there's such a direct correlation between racism and Obama's chances, but it doesn't surprise me. The people I know who really hate Obama are the same people I've had to berate for sending me racist email jokes for years. Yet even some of those people voted for Obama with a rationale that was something along the lines of, "the Republicans have screwed up so bad that I have to vote for the black guy." The president is going to have to figure out some way to peel away some of these voters again, or he'll lose:

Barack Obama won 52.9 percent of the popular vote in 2008 and 365 electoral votes, 95 more than he needed. Many naturally concluded that prejudice was not a major factor against a black presidential candidate in modern America. My research, a comparison of Americans' Google searches and their voting patterns, found otherwise. If my results are correct, racial animus cost Mr. Obama many more votes than we may have realized.

Quantifying the effects of racial prejudice on voting is notoriously problematic. Few people admit bias in surveys. So I used a new tool, Google Insights, which tells researchers how often words are searched in different parts of the United States.

Can we really quantify racial prejudice in different parts of the country based solely on how often certain words are used on Google? Not perfectly, but remarkably well.Google, aggregating information from billions of searches, has an uncanny ability to reveal meaningful social patterns. "God" is Googled more often in the Bible Belt, "Lakers" in Los Angeles.

The conditions under which people use Google — online, most likely alone, not participating in an official survey — are ideal for capturing what they are really thinking and feeling. You may have typed things into Google that you would hesitate to admit in polite company. I certainly have. The majority of Americans have as well: we Google the word "porn" more often than the word "weather.""

"In the United States and around the world," Clinton said, "progress is being made. The tireless advocacy of generations is bending the arc of history. Barriers are being torn down, discriminatory laws repealed, and millions are now able to live more freely and participate in the future of their communities and countries. But there is still much more to be done. Gay, lesbian, bisexual, and transgender men and women continue to be persecuted and attacked. They are arrested, beaten, terrorized, and even executed."

She discussed projects mounted by U.S. embassies to stage rights marches, hold rallies, sponsor film festivals and other outreach efforts in the name of educating people and raising awareness."



Illinois, Cook County Leads Nation In Wrongful Convictions

Illinois, spurred on by Cook County, leads the nation in wrongful convictions according to a recent report by theThe National Registry of Exonerations is a joint project of the University of the Michigan Law School and theCenter on Wrongful Convictions at Northwestern University School of Law.

Since 1989, 101 people in Illinois have had their convictions overturned. 78 of those cases came from Cook County. That's nine percent of the 891 wrongful convictions listed in the report. The most recent wrongful conviction in Illinois was James Kluppelberg, who had his conviction for a 1984 arson overturned because evidence used in the trial was discredited and a witness who testified Kluppelberg confessed to the crime admitted he lied. Other cases listed in the report link back to the torture practices of former Chicago Police Lt.Jon Burge.

Yesterday, the House of Representatives moved to help save $30 million dollars for medical device companies while defunding programs designed to expand health coverage for ordinary Americans. The House took action on legislation to "repeal a 2.3 percent excise tax on gross sales receipts in excess of $5 million for manufacturers and importers of certain medical devices, including defibrillators, pacemakers and prosthetic limbs." The tax, originally part of the Affordable Care Act, was set up to pay for an expansion in health programs to cover the uninsured in America, which studies have linked to over45,000 deaths a year.

The repeal comes as medical device makers, a $140 billion industry, have lobbied aggressively and showered lawmakers with contributions. A report from the Center for Budget and Policy Priorities notes that the tax would likely spur innovation by promoting cost-effective ways of delivering care, while also ensuring vital health programs are properly funded. Nevertheless, the House passed the bill242-173.

The medical device lobby had several advantages in this fight. For one thing, they had a man in the inside. In late 2010, as Congressman John Boehner (R-OH) prepared to take the gavel as Speaker, he hired a lobbyist named Brett Loper as his new policy chief. Loper left his job at the Advanced Medical Technology Association, a lobby group for medical device-makers, to join Boehner.

Republic Report reviewed ethics forms disclosed filed with the House clerk's office, and noticed that Loper actually received a $100,147 bonus in 2011 for leaving his medical device lobbying group and becoming a public servant. View the disclosure here.

The reverse-revolving door phenomenon has grown in recent years, with lobbyists taking powerful roles within government, putting them in a position to affect outcomes on issues they addressed in their lobbying jobs. As Republic Report exclusively reported, Senator Marco Rubio's (R-FL) chief of staff is a lobbyist who continues to receive payments from his old lobbying firm, despite the fact that he now oversees policy for Rubio's office. Senator Tim Johnson (D-SD), who will be overseeing the investigation of J.P. Morgan's trading loss, hired staff director, Dwight Fettig, a former J.P. Morgan lobbyist, back in 2011 as well.

While much attention has been paid to the number of lawmakers and staff who sell out and become lobbyists, there's equally problematic dynamic when lobbyists burrow into government, provide key giveaways to industry or special interests, then return to K Street with even higher salaries.

Update: A story from Politico in 2010 notes that Loper, as a medical device lobbyist, was "deeply involved" in fighting the medical device tax that was ultimately repealed yesterday.

Citizens United Unleashed in Wisconsin Recall #p2 #tcot

Recent campaign filings show Governor Scott Walker raising over $30 million to defend himself against recall versus $3.9 million raised by his challenger Milwaukee Mayor Tom Barrett. Barrett is being outspent 12:1, but even these numbers do not account for the full amount of spending in the race. Since the U.S. Supreme Court's decision in the Citizens United case, an array of outside groups are playing a major role in elections and Wisconsin is no exception.

Wisconsin's historic recall battle may be seen as a test of grassroots gumption (30,000 volunteers collected close to one million recall signatures) against big outside money in a post-Citizen's United world. With less than a week before the election, spending numbers regarding these outside interest groups are changing by the hour. The nonpartisan Wisconsin Democracy Campaign (WDC) is working hard to track the money and illuminate exactly how high the spending outside of the candidates will go. Right now, WDC pegs total spending in the race at $62 million, including at least $21.4 million in disclosed spending by outside groups in addition to an estimated $7.5 million in undisclosed spending on so-called "issue ads" designed to influence the election.

Here is a brief look at the five biggest outside interest groups spending in Wisconsin's 2012 recall.

Republican Governors Association Claims "Just the Facts"

The Republican Governors Association (RGA)'s Political Action Committee "Right Direction Wisconsin" (RGA-RDW) has been the biggest outside spender in this year's recall election. WDC reports that the group has spent $8.6 million since January 2012 with almost all of their spending going towards TV ads. RGA-RDW considers these ads to be "issue ads" and so does not file any disclosure about the donors whose funds make the ad buys possible. The RGA also operates a "527" group, which does disclose its donors to the IRS, and this may eventually provide some insight into the money behind RGA's messages.

In late March, RGA-RDW ran three ads, one attacking Barrett, one attacking his main primary challengerKathleen Falk, and one attacking both Barrett and Falk for their records as Milwaukee Mayor and Dane County Executive, respectively. Two weeks before the primary, the group sponsored another ad against Barrett, and after the May 8 primary, it ran three ads (herehere, and here) criticizing Barrett and praising Walker. One of RGA-RDW's most widely circulated ads, embedded above, claims to be all about the facts, but it omits key facts, such as the fact that unemployment rose 34 percent under Scott Walker during his term as Milwaukee County Executive, and it omits information about Wisconsin being ranked 50th out of 50 states in the nation on jobs.

Koch money is the RGA's top source for contributions in the 2012 election cycle, with the corporation's co-owner David Koch donating at least $2 million and the company itself giving $25,000. In 2010, the RGA spent $3.4 million to help get Walker elected, with $1 million in help from David Koch and another $50,000 from Koch Industries for RGA to spend among the gubernatorial candidates it was backing, including Walker. In addition, Koch Industries PAC was one of the largest contributors to Walker's campaign for office in 2010.

In contrast, the Democratic Governors Association is not directly running ads in Wisconsin, but is reportedly funding the Greater Wisconsin Committee, spending $1 million.


Walker Wins Recall, Democrats Win Control of the Senate Halting Right-Wing Agenda #p2 #tcot

After a 16-month long fight, an astonishing $63.5 million spent, and a people's uprising that attracted international attention and laid the groundwork for a movement that will last for years to come, Governor Scott Walker will keep his seat after Tuesday's recall election, winning 53-46 over challenger Tom Barrett. Lt. Governor Rebecca Kleefisch also survived her recall challenge.

In the early hours of the morning, word came from Southeastern Wisconsin that former state Sen. John Lehman, D-Racine, beat incumbent Republican Sen. Van Wanggaard, with 36,255 votes to Wanggaard's 35,476 votes, according to unofficial results with all precincts reporting. Combined with two other successful Senate recalls in August of 2011, this win means Democrats flipped the Senate from Republican control and put a halt to the Walker agenda.

A Historic Struggle Over Tremendous Odds

Walker was voted into office in 2010 with a promise to create 250,000 jobs in his first term -- which was appealing to a residents of a state suffering from an economic downturn caused by Wall Street gambling. During the campaign, Walker indicated that he would ask public sector unions to pay more into their health care and pensions, but never suggested that he would attack their right to collectively bargain, which public workers in Wisconsin have had for fifty years.

Walker first announced his plans to roll back collective bargaining rights on February 11, 2011 and anticipated the fight would be over in less than a week. Walker announced his "Budget Repair Bill" (Act 10) on a Friday and planned a vote the following Wednesday, leaving almost no time for public debate or deliberation. He even scheduled a bill signing at the end of the week.

Things did not go according to plan. Students, firefighters, and many others occupied the capitol for 18 days. Hundreds of thousands of people marched on the Capitol after 14 Senate Democrats delayed the vote by exiting the state. When the vote was eventually lost in March of 2011, many protesters vowed to recall Walker.

The task was not a small one. Wisconsin's recall law, which had never been used in a statewide election since its creation in 1926, first required that protesters wait a year before initiating a recall. Next, it required that advocates gather signatures equivalent to 25 percent of ballots cast in the last election -- one of the highest recall thresholds in the nation, much greater than the 12 percent required in California. Volunteers were tasked with gathering 540,000 signatures in 60 days a very high hurdle. But starting in November 2011, 30,000 volunteers braved a cold Wisconsin winter to greatly exceed that number, collecting over 930,000 signatures and triggering the recall election.

At that point, another problem with the recall process quickly emerged. A campaign finance loophole allowed a politician facing recall to accept unlimited campaign donations. This allowed Walker to accept checks for $100,000, $250,000, and $500,000 -- for a total of $30.5 million -- while his opponents engaged in a Democratic primary had to abide by a $10,000 contribution cap. No opponent could overcome this astonishing financial advantage. Finally, because of the Democratic primary on May 8, there was only four weeks for the  winner to raise money, cut ads and campaign around the state. 

Democrats Unable to Match Avalanche of Outside Money

Around $63.5 million was spent in the election. $45 million of that $63.5 million -- more than 70 percent -- came from Walker's campaign and supporters. Because of the loophole in Wisconsin campaign finance law, Walker out-raised Barrett 7.5 to 1 ($30.5 million to $4 million at last count). Two-thirds of Walker's money came from out-of-state, versus only one-fourth of Barrett's money coming from outside Wisconsin.

According to Mike McCabe of the nonpartisan Wisconsin Democracy Campaign, which tracks money in politics, "Money doesn't talk, it screams. And that is what we saw in this election."

CNN On Solyndra Loan: Bush Started It, There’s No Evidence of Wrongdoing, And Romney’s Attacks Are Made Up #p2 #tcot @MittRomney


CNN has two dynamite pieces on Solyndra, "Romney wrong on Solyndra facts" and "Seven things you should know about Solyndra."

The first one, by Steve Hargreaves of CNN Money, ends:

It's one thing to spin something to one's advantage. It's another to simply make things up to make the other guy look bad. Romney's Solyndra speech was an example of the latter. Disgraceful.

Hargreaves shows that Mitt Romney's key claim — "An independent inspector general looked at this investment and concluded that the Administration had steered money to friends and family and campaign contributors" — has no basis in fact.

The second piece, also by Hargreaves, lists 7 key facts:

1.  It was started by Bush: The DOE loan program that funded Solyndra was actually started by President Bush in 2005. It was intended to provide government support for "innovative technologies"….

In fact, as Climate Progress reported back in September, the "Bush Administration advanced the Solyndra loan guarantee for two years" before Obama became President.

2.  Congress thought there would be more failures: Two companies have declared bankruptcy under the loan program so far, out of the 33 projects funded. Congress was expecting more….

Congress appropriated money to cover expected losses, and multiple independent reviews have confirmed that the actual losses will likely be less than Congress expected.

"In an interview with MSNBC's Andrea Mitchell today, Miami Herald reporter Marc Caputo offered more details as to who is being targeted in Florida Governor Rick Scott's attempt to purge "non-citizens" from the state's voter rolls.

Out of about 2,600 people identified by the Scott administration as non-citizens, Caputo said, 1,600 of them reside in Miami-Dade County. And 58 percent of them were Hispanic voters and voters who registered as independents.

State election commissioners already stopped following Scott's orders to trim the voter rosters, citing "just too many variables" to continue the process."

Mike Leavitt, the man Mitt Romney has tapped to head his transition should he win this November, has held a wide array of public-sector jobs including Governor of Utah and Secretary of Health and Human Services. But perhaps most interesting is the fifteen months he spent from November 6, 2003 through January 26, 2005 as President George W. Bush's EPA administrator — a period over which he supported many of the environmental protection efforts Romney has railed against through the campaign.

Romney's official campaign website has a prominent section on government regulations entitled "Obama's Failure," which blasts the EPA for "endless new regulations touching on countless other forms of economic activity—regulations that drive up costs, hinder investment, and destroy jobs. Romney has added that "there are other people who would like to put in place a cap-and-trade program and dramatically increase the cost of energy. That's their view. And by the way, that would kill a lot of jobs."

Leavitt has a rather opposite record. In his introductory address to his EPA employees, enthusiastically endorsed a cap-and-trade, telling them:

We need to take the giant step toward national market-based solutions; to do that we need only look to our own experience. That is exactly what we're doing with cap and trade. The cap and trade strategy was key to the breakthrough against acid rain. It is central to Clear Skies. The cap and trade approach shows us again and again that people do more and they do it faster when they have an incentive to do what's in the public's interest.

And, a ThinkProgress analysis of Regulations.gov data reveals that between Leavitt's first day as administrator to his last, the agency promulgated or amended 232 regulatory rules. These
included tougher standards for ozone, diesel fuels, and other air pollutants. Among these were things likeNational Ambient Air Quality Standards for Particulate Matter, National Emission Standards for Hazardous Air Pollutants for Asbestos, and Protection of Stratospheric Ozone; Refrigerant Recycling; Substitute Refrigerants— the sorts of regulations Romney says "drive up costs, hinder investment, and destroy jobs."

Given their opposite views on these issues and Leavitt's strong support of ObamaCare, he seems a surprising choice to lead Romney's transition.

Right-wing media have attacked the Department of Justice's decision to send personnel to Milwaukee to monitor the Wisconsin recall election for violations of the Voting Rights Act of 1965. But Congress authorized DOJ to monitor elections for violations of citizens' voting rights, and the Bush administration DOJ often exercised this power.

DOJ Announces It Will Monitor Elections For Voting Rights Violations In Milwaukee And Elsewhere

DOJ Announces That It Is Monitoring Elections To Prevent Discrimination "On The Basis Of Race, Color Or Membership In A Minority Language Group." In a June 4 press release, the Department of Justice (DOJ) announced that it would monitor elections in a few municipalities in the states of California, New Mexico, South Dakota and Wisconsin. From the press release:

The Justice Department announced today that it will monitor elections on June 5, 2012, in the following jurisdictions to ensure compliance with the Voting Rights Act of 1965 and other federal voting rights statutes: Alameda, Fresno and Riverside Counties, Calif.; Cibola and Sandoval Counties, N.M.; Shannon County, S.D.; and the city of Milwaukee.

The Voting Rights Act prohibits discrimination in the election process on the basis of race, color or membership in a minority language group.  In addition, the act requires certain covered jurisdictions to provide language assistance during the election process.  Fresno County, Riverside County and the city of Milwaukee are required to provide assistance in Spanish.  Cibola, Sandoval and Shannon Counties are required to provide language assistance to Native American voters.  Alameda County is required to provide language assistance to Hispanic, Chinese, Vietnamese and Filipino voters.

Under the Voting Rights Act, the Justice Department is authorized to ask the U.S. Office of Personnel Management (OPM) to send federal observers to jurisdictions that are certified by the attorney general or by a federal court order.  Federal observers will be assigned to monitor polling place activities in Shannon County based on the attorney general's certification and in Alameda, Riverside and Sandoval Counties based on court orders.  The observers will watch and record activities during voting hours at polling locations in these jurisdictions, and Civil Rights Division attorneys will coordinate the federal activities and maintain contact with local election officials.

Right-Wing Media Responds To The Announcement With Fear Mongering And Race Baiting

Invoking New Black Panthers, CNN's Loesch Asked "What Kind Of 'Monitoring' Will These Federal Employees Engage In?" In a June 4 post on Breitbart.com's Big Government, CNN contributor Dana Loesch claimed that "the DOJ is suddenly interested in voter fraud ... [e]ven voter fraud where it legitimately doesn't exist." She also falsely claimed that "the DOJ has ... sanctioned 'election monitoring' (after the fact) by New Black Panther Party members standing outside of the polls with nightsticks." From the post:

For those keeping score: the DOJ has, in the past, sanctioned "election monitoring" (after the fact) by New Black Panther Party members standing outside of the polls with nightsticks. That was for an election where Democrat Barack Obama was the likely victor. Breitbart.com's Dan Riehl: "The Entire Thing Is A Fiasco."  In a June 5 post on his personal blog, Breitbart.com blogger Dan Riehl wrote:

Typical Democrat strategy, why wait until the votes are counted? We already know we want a recount, if we don't win! "Wisconsin recall: Democrats prepare for recall recount" That's the mark of a sore losers party; Democrats are that. Sadly, their whiny persistence does pay off on the margins. Politics is getting increasingly worse in America. 

Today is the day and I can't say I'm thrilled about this development. The right doesn't have much faith in Holder's DOJ for good reason. Can you say, Fast and Furious? 

Wisconsin is one of four states whose elections the U.S. Justice Department is monitoring to ensure against discrimination. The federal officials will be monitoring the elections to make sure they comply with the Voting Rights Act of 1965.

Frankly, the entire thing is a fiasco, with much of it going ignored beneath the headlines.

Also on the ballot today are five other Republican seats up for recall: the offices of lieutenant governor and four state senators. The possible outcomes are complicated and in some cases could leave the state's voters with no consensus on which parties' policies they prefer.

In Fact, The Voting Rights Authorizes DOJ To Monitor Elections To Protect Against Violations Of Citizens' Right To Vote

DOJ: In 1975 The Voting Rights Act Was Broadened To "Address Voting Discrimination Against Member of Language Minority Groups." From the DOJ website regarding Section 5 of the Voting Rights Act:

In 1975, the special provisions of the Voting Rights Act were extended for another seven years, and were broadened to address voting discrimination against members of "language minority groups." An additional coverage formula was enacted, based on the presence of tests or devices and levels of voter registration and participation as of November 1972. In addition, the 1965 definition of "test or device" was expanded to include the practice of providing election information, including ballots, only in English in states or political subdivisions where members of a single language minority constituted more than five percent of the citizens of voting age. This third formula had the effect of covering Alaska, Arizona, and Texas in their entirety, and parts of California, Florida, Michigan, New York, North Carolina, and South Dakota. Under The Voting Rights Act, Milwaukee Has A "Legal Obligation To Provide ... Minority Language Assistance" To Spanish-Speaking Citizens. Pursuant to a formula established by the Section 203 of the Voting Rights Act, the Census Bureau determined in 2011 that Milwaukee has a "legal obligation to provide [Spanish] language assistance" to voters. During calendar year 2008 (through September 30th), 397 federal observers and 158 Department personnel have been sent to monitor 51 elections in 47 jurisdictions in 17 states. For the 2008 elections, the Civil Rights Division will implement a comprehensive Election Day program to help ensure ballot access. As in previous years, the Civil Rights Division will coordinate the deployment of hundreds of federal government employees in counties, cities and towns across the country to ensure access to the polls as required by our nation's civil rights laws. In 2007, DOJ Monitored Florida County Election To Ensure Compliance With Requirement To Provide "Voter Assistance Information In Spanish." From  a March 19, 2007, DOJ press release:

The Justice Department today announced that on Tuesday, March 20, 2007, it will monitor special elections in Osceola County, Fla., and Randolph County, Ga., to ensure compliance with the Voting Rights Act.

Justice Department personnel will monitor polling place activities in Osceola County, Fla. A Civil Rights Division attorney will coordinate the federal activities and maintain contact with local election officials.

Osceola County, Fla., has an obligation under Section 203 of the Voting Rights Act to provide all election information, ballots and voting assistance information in Spanish as well as in English. The monitors will gather information concerning compliance.

Under the Voting Rights Act, the Justice Department is authorized to ask the Office of Personnel Management to send federal observers to areas that are specially covered in the Act itself or by a federal court order. Based on the special coverage provisions, federal observers will be assigned to monitor polling places in Randolph County, Ga.

The observers will watch and record activities during voting hours at polling locations in Randolph County and will monitor to ensure that the right of voters to participate in the election is not denied on the basis of their race. A Civil Rights Division attorney will coordinate the federal activities and maintain contact with local election officials.

Each year, the Justice Department deploys hundreds of federal observers from the Office of Personnel Management, as well as departmental staff, to monitor elections across the country. This compares to the 640 federal observers and 110 Department personnel deployed during the entire 2000 presidential calendar year. In 2006, another record was set for the mid-term elections with more than 800 federal observers and Department personnel sent to monitor polling places in 69 jurisdictions in 22 states on election day. The Department's election monitoring program also has been very active in non-federal election years. In calendar year 2005, for example, 640 federal observers and 191 Department personnel were sent to monitor 47 elections in 36 jurisdictions in 14 states. Under the Voting Rights Act, the Justice Department is authorized to ask the Office of Personnel Management to send federal observers to areas that are specially covered in the Act itself or by a federal court order. Federal observers will be assigned to monitor polling place activities for the special elections in Jefferson Davis and Tunica Counties, Miss., based on the special coverage provisions.

The observers will watch and record activities during voting hours at polling locations in these jurisdictions. Civil Rights Division attorneys will coordinate the federal activities and maintain contact with local election officials.

In addition, Justice Department personnel will monitor polling place activities in Fort Worth, Texas. A Civil Rights Division attorney will coordinate these activities and maintain contact with local election officials.

Federal observers and Department personnel will monitor to ensure that the right of voters to participate in the election is not infringed on account of their race or membership in a language minority group.

The Department will monitor voting procedures in polling places and in the Clerk's office to ensure compliance with federal law. The Department has authority to monitor the elections pursuant to a consent decree entered on April 19, 2004, in U.S. v. Pulaski County, et al., to resolve the Department's allegations that the county had violated the National Voter Registration Act ("NVRA").

The consent decree requires county officials to develop and implement uniform and nondiscriminatory rules and policies governing the maintenance of an accurate and current voter registration roll for elections for federal office, as well as ensure that eligible applicants be registered to vote in a timely and effective manner.

Each year, the Justice Department deploys hundreds of federal observers from the Office of Personnel Management, as well as Departmental staff, to monitor elections across the country. In 2004, a record 1,463 federal observers and 533 Department personnel were sent to monitor 163 elections in 105 jurisdictions in 29 states. In 2002, the last comparable year in the four year election cycle, there were 608 federal observers and 221 Department personnel deployed to 60 elections in 40 jurisdictions in 17 states. Last year for off-year elections there were 640 federal observers and 191 Department personnel sent to monitor 47 elections in 36 jurisdictions in 14 states. [Department of Justice, 5/22/06]

In 2003, DOJ Monitored Elections In States Across The Nation To Protect Rights Of "Language Minority Group[s]." From an October 31, 2003, DOJ press release:

The Justice Department today announced that it will send 160 federal observers and 39 Civil Rights Division personnel to 15 counties in 8 states to monitor state and local elections on November 4, 2003. These activities are part of Attorney General John Ashcroft's Voting Access and Integrity Initiative.

Under the Voting Rights Act, which protects the rights of Americans to participate in the electoral process without discrimination, the Justice Department is authorized to ask the Office of Personnel Management (OPM) to send federal observers to areas that are specially covered in the Act itself or by a federal court order under the Act.

"It is a priority of this Administration to ensure that all Americans are able to vote, free of hostility, harassment, or intimidation," said Assistant Attorney General R. Alexander Acosta. "The observers and Civil Rights Division personnel will monitor Election Day activities to ensure access to the polls and prevent discrimination."

For three counties, federal observer authority comes from court orders, and observers were assigned to another eight counties based on the special coverage provisions. Federal observers will monitor polling place activities in:

  • Wayne County (Hamtramck), Michigan;
  • Humphreys, Jones, Kemper, Leake, Neshoba, Newton, Noxubee and Winston counties, Mississippi;
  • Passaic County, New Jersey; and,
  • Berks County (Reading), Pennsylvania.

The observers will watch and record activities during voting hours at select polling locations in these counties. Twenty-one Justice Department personnel will coordinate the federal activities and maintain contact with local election officials.

In addition, Civil Rights Division personnel, most of whom are attorneys, will monitor elections in:

  • San Francisco County, California;
  • Jefferson County (Louisville), Kentucky;
  • Essex County (Lawrence), Massachusetts;
  • Queens County, New York; and,
  • Harris County (Houston), Texas.

The observers and Department personnel will monitor whether certain counties and localities are complying with federal voting laws, for example: complying with the minority language provisions of the Voting Rights Act; determining whether any voters are challenged improperly on the basis of their race, color, or membership in a language minority group; permitting voters who are blind, disabled or unable to read or write assistance by a person of their choice; and permitting all eligible voters to cast a ballot. In 2002, DOJ Monitored Elections In Arizona, Florida And New York To Ensure Fair Treatment Of Members Of Language Minorities. From a September 9, 2002, DOJ press release:

The Justice Department will send 80 federal observers to Apache and Navajo Counties, Arizona; 17 Department personnel to Miami-Dade, Orange and Osceola Counties, Florida; and 12 Department personnel to Queens and Suffolk Counties, New York to monitor the primary elections on Tuesday, September 10, 2002.

Under the Voting Rights Act, which protects the rights of Americans to participate in the electoral process without discrimination, the Justice Department is authorized to ask the Office of Personnel Management (OPM) to send federal observers to areas that are specially covered in the Act.

In Arizona, information provided by the federal observers, most of whom are bilingual in English and Navajo, will assist the Justice Department in efforts to ensure that all written election materials are translated orally into the Navajo language for voters who speak it as a primary language. Additionally, observers will monitor the counties to see if trained poll workers assist Navajo speaking voters.

The observers, who are supervised by OPM, will watch and record activities during voting hours at select polling locations in the counties. Ten Justice Department attorneys will coordinate the federal activities and maintain contact with local election officials.

In Florida, Justice Department personnel are authorized to be present in the polls by U.S. District Courts under consent decrees with each county entered earlier this year. In Miami-Dade County, personnel will monitor the treatment of Haitian-American voters to ensure they have full and equal access to the voting process. In Orange and Osceola Counties, personnel, some of whom are bilingual in English and Spanish, will monitor the treatment of Hispanic voters and the delivery of Spanish language assistance to Hispanic voters with limited English proficiency. Three Justice Department attorneys will coordinate the monitoring and maintain contact with local election officials.

In New York, Justice Department personnel have obtained permission from local election officials to be present in the polls during voting hours. In Queens County, personnel will monitor whether the county has implemented procedures to comply with the minority language provisions of the Voting Rights Act with respect to Korean-American voters with limited English proficiency, and in Suffolk County, personnel will monitor Spanish language assistance procedures. Two Justice Department attorneys will coordinate the federal activities and maintain contact with local election officials. [The Department of Justice, 9/2/02]

In 2001, DOJ Monitored "Treatment Of Hispanic Voters" During Illinois Election. From a April 2, 2001, DOJ press release:

The Justice Department will dispatch 37 federal observers to the town of Cicero, Ill. to monitor the municipal general election on April 3, 2001.

Under the Voting Rights Act, which protects the rights of Americans to participate in the electoral process without discrimination, the Justice Department is authorized to ask the Office of Personnel Management (OPM) to send federal observers to areas that are covered by a court order. In this case, the U.S. District Court in Chicago authorized observers in October 2000 under an agreed stipulation and order between the Justice Department and the Cook County Clerk. Last February, the Justice Department dispatched federal observers to Cicero to monitor the municipal primary election.

The federal observers, who are supervised by OPM, will watch and record activities during voting hours at select polling locations. The observers will monitor the treatment of Hispanic voters to ensure that they have full and equal access to the voting process. In addition, four Justice Department attorneys will coordinate the federal observer activities and maintain contact with local election officials. [Department of Justice, 4/2/01, emphasis added]
