Virginia Attorney General Kenneth Cuccinelli has filed a petition with the 4th Circuit U.S. Court of Appeals in Richmond asking the full 15-judge court to reconsider a decision by a three-judge panel last month that overturned the state's sodomy law.Yep, Cuccinelli is appealing the decision, going to the mat to demand that Virginia continue to criminalize … sodomy. Not just scary gay sex, mind you, but the straight kind o' sodomy as well, and in apparent opposition to the Supreme Court decision saying that what two consenting adults do in their own bedroom is none of the government's business.The three-judge panel ruled 2-1 on March 12 that a section of Virginia's "Crimes Against Nature" statute that outlaws sodomy between consenting adults, gay or straight, is unconstitutional based on a U.S. Supreme Court decision in 2003 known as Lawrence v. Texas.
A clerk with the 4th Circuit appeals court said a representative of the Virginia Attorney General's office filed the petition on Cuccinelli's behalf on March 26. The petition requests what is known as an en banc hearing before the full 15 judges to reconsider the earlier ruling by the three-judge panel.
Why? Is there a big anti-oral-sex contingent among the Cuccinelli base that he figures needs catering to? Really? Really? You're thinking that's going to be the big hot-button election issue in the next couple years, sport? What's your enforcement mechanism going to be here—and I forget, does this count as the kind of government overreach and tyranny and big-brotherism that Republicans are always talking about, or is that sort of outrage only for when the first lady publicly suggests that kids eat their vegetables?
